Born To Paragliding – Terms & Conditions

1. Acceptance of Terms:

By booking a paragliding experience with Born To Paragliding, you (“Participant,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not participate in our activities.

2. Booking and Payment:

  • Reservations: Bookings are subject to availability and confirmation. A booking is considered confirmed upon receipt of a deposit or full payment as specified.
  • Payment: Payment can be made via UPI/Credit-Card/Debit-Card/Bank Transfer/Cash. Full payment is required at the time of activity.
  • Pricing: Prices are subject to change without notice. Any changes will not affect confirmed bookings.
  • Deposits: Deposits are non-refundable unless Born To Paragliding cancels the activity due to unforeseen circumstances (e.g., weather).

3. Participant Requirements and Responsibilities:

  • Health and Fitness: Paragliding requires a reasonable level of physical fitness. Participants must be free from any medical conditions that could be aggravated by the activity. You are responsible for disclosing any relevant medical information.
  • Weight Limits: Participants must adhere to specified weight limits 30 – 90 KG.
  • Age Restrictions: Participants must be [Specify age restrictions]. Minors must be accompanied by a legal guardian with signed consent.
  • Alcohol and Drugs: Participants must not be under the influence of alcohol or drugs.
  • Instructions: Participants must follow all instructions given by Born To Paragliding staff and pilots.
  • Personal Belongings: Born To Paragliding is not responsible for any loss or damage to personal belongings. Participants are advised to secure their valuables.
  • Liability Release: Participants will be required to sign a liability release form before participating in any activity.

4. Cancellation and Refunds:

  • Participant Cancellation:
    • Cancellations made within 1 Day before the scheduled activity may be eligible for a partial refund or rescheduling, subject to a cancellation fee.
    • Cancellations made within 24 hours of the scheduled activity are non-refundable.
    • No show will result in a forfeit of all monies paid.
  • Born To Paragliding Cancellation:
    • Born To Paragliding reserves the right to cancel or reschedule activities due to weather conditions, safety concerns, or other unforeseen circumstances.
    • In the event of cancellation by Born To Paragliding, participants will be offered a full refund or the option to reschedule. 
  • Weather Conditions: Paragliding is heavily dependent on weather. Born To Paragliding will make the final decision regarding flight safety. If a flight is canceled due to weather, participants will be offered a reschedule or refund.

5. Safety and Liability:

  • Risk Acknowledgment: Paragliding is an adventure sport with inherent risks. Participants acknowledge and accept these risks.
  • Liability Waiver: Participants agree to release Born To Paragliding, its staff, and pilots from any liability for injury, loss, or damage arising from participation in our activities, except in cases of gross negligence.
  • Insurance: Participants are advised to have their own personal accident and travel insurance.
  • Pilot Authority: The pilot has the final authority on all matters relating to flight safety.

6. Media Release:

  • Participants grant Born To Paragliding the right to use any photographs or videos taken during the activity for promotional purposes, unless otherwise stated in writing.

7. Governing Law:

  • These Terms & Conditions shall be governed by and construed in accordance with the laws of Tourism.

8. Changes to Terms & Conditions:

  • Born To Paragliding reserves the right to modify these Terms & Conditions at any time. Any changes will be posted on our website.

10. Force Majeure:

Born to paragliding shall not be liable for any failure or delay in performing its obligations under these terms and conditions if such failure or delay is caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, strikes, lockouts, or other industrial disputes. 

11. Severability:

If any provision of these terms and conditions is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable. 

Liability Release (Example of information to be included in the release form):

  • I acknowledge the risks involved in paragliding.
  • I confirm that I am physically and mentally fit to participate.
  • I release Born To Paragliding from any liability.
  • I have read and understood these Terms & Conditions.
